Proshine Pressure Washing - Comprehensive Service Agreement

This agreement establishes the terms and conditions between Proshine Pressure Washing (ABN 69146278661), hereinafter referred to as "Proshine," and the customer (hereinafter referred to as the "Client") regarding the provision of goods and/or services by Proshine Pressure Washing.

1. Acceptance of Terms

By instructing Proshine Pressure Washing to provide any goods and/or services, accepting such goods or services, or acknowledging these terms in any other manner recognized by law, the Client is deemed to have accepted and be bound by these terms. Any amendments to these terms must be made in writing and agreed upon by both parties.

2. Scope of Services

2.1. Service Delivery: Proshine agrees to provide cleaning services ("Service") to the Client as specified in the agreed quotation.

2.2. Acknowledgment of Varied Results: The Client understands that perfect results are not guaranteed due to factors such as the condition of the surfaces and materials. Refunds are not provided based on varied results.

2.3. Special Cleaning Requirements: The Client must inform Proshine of any special cleaning requirements for coated, designer glass, or tinted surfaces. Proshine is not liable for damage caused by insufficient information.

2.4. Pre-existing Conditions: Proshine is not liable for pre-existing scratches on glass surfaces or for the removal of glass stains and post-construction debris, unless specified otherwise.

2.5. Access To Water:  Proshine requires access to water for all services. If the Client does not have access to water it must be specified before commencing work. Failure to provide access to water at the time of your appointment will result in a $50 cancelation fee or %10  of the service cost, whichever is greater.

2.6. Rescheduling: Proshine reserves the right to cancel or reschedule in accordance with its staff availability, weather conditions or equipment failure. Gift Certificate redemption appointments will follow the same cancellation policy and will be automatically redeemed for $50 based on the Cancellation policy guidelines.

2.7. Additional Charges: Additional charges may apply if site conditions differ from the initial assessment or if additional services are requested beyond the standard maintenance clean.

3. Gutter Cleaning

3.1. Standard Service: The standard gutter cleaning service focuses on functionality rather than presentation. Additional charges apply for cleaning for presentation purposes or for clearing blocked downpipes.

3.2. Extra Charges: Pressure washing gutters or downpipes to a totally dirt-free standard incurs extra charges.

4. Pressure/Soft Washing Services

4.1. Stain Removal: While efforts are made to remove stains, some materials may be irreversibly stained. Tree sap, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means Proshine is not liable for any stains on porous surfaces.

4.2. Concrete Surfaces:  The appearance of concrete depends on a number of factors most linked to when the concrete was initially poured and cured. When concrete with dirt, mold, mildew, algae and other pollutants and stains is cleaned, the concrete will then reveal any and all imperfections that the pollutants and stains have covered up. The customer understands that not all concrete will look the same even on the same driveway, patio, sidewalk, or concrete slab. 

4.3. Removal & Replacement of Deck Contents: Removal and replacement of grills, deck furniture, planters, and any other items are the responsibility of the homeowner. Should we need to remove items from the deck, we will not be responsible for any damage, breakage or for storage issues. An additional charge may be applied for the time and labor devoted to the removal of these items. 

4.4. Damages:  Proshine Pressure Washing is not responsible for damages due to improperly installed siding, loose tiles or siding, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters, and downpipes and improper caulking. In every aluminum siding case and in some cases with vinyl siding, the sun and weather will bleach the color or cause fading. Power washing, which entails the removal of chalky, gritty, or failing surface materials may cause the faded aspects of the vinyl or aluminum to stand out. Proshine will not be responsible for such conditions. Proshine will not be responsible for loose mortar that may dislodge during the cleaning process. 

4.5. Water Spotting:  Windows may become water spotted as a result of our services. Window cleaning is not included unless otherwise specified or listed in quotation.

4.6. Property Condition: The Client must ensure that the property is in good repair and weathertight. Proshine is not responsible for damages as a result of water infiltration from poor or improper installation, maintenance, or repair of electrical-related items or doors or windows. 

5. Complaints

5.1. Registration of Complaints: Any complaints regarding the quality of work must be registered within 3 business days, accompanied by photos.

5.2. Resolution: Legitimate complaints will be rectified at an arranged time.

6. Inclement Weather

6.1. Rain Guarantee: A 7 Day Rain Guarantee is offered for visibly dirtied glass due to rain or stormy weather within 7 days of the completed clean.

7. Limitation of Liability

7.1. Release and Indemnification: The Client releases and indemnifies Proshine from all claims relating to the services provided. Proshine's liability is limited to the price of the goods and/or services and excludes indirect losses.

8. Cancellations

8.1. Cancellation Fees: Last-minute cancellations (less than 48 hours notice) incur a fee of $50 or 10% of the service cost, whichever is greater.

9. Payment

9.1. Invoice Terms: Invoices are due within 24 hours unless otherwise agreed upon. Additional fees may apply for late payments.

10. Additional Terms and Conditions

10.1. Legally Binding Agreement: By booking a service with Proshine Pressure Washing, you automatically agree to these terms of service. Breach of contract may result in surrendering deposits as damages.

10.2. Product Warranties: All warranties are limited to those offered by the manufacturers of the products used. Proshine makes no additional warranties.

10.3. Water and Electrical Usage: The Client agrees to provide Proshine the right to use on-site water and electricity as needed without compensation.

10.4. Courtesy: The Client is responsible for keeping children, pets, and others away from the work area during service.

10.5. Removal & Replacement of Contents: The homeowner is responsible for removing and replacing items from the work area. Proshine is not liable for damages or storage issues.

10.6. Weather & Scheduling: Proshine will try to minimize scheduling conflicts, but inclement weather may affect project timelines. The Client will be notified of any changes.

10.7. Risks and Releases of Liability: The Client assumes responsibility for any damage due to improper maintenance. Proshine is not responsible for damage due to improper installation or maintenance issues.

10.8. House Wash Acknowledgement: The Client understands that existing flaws may become more prominent after the Service.

10.9. Stains: Some stains may require additional treatment. Proshine will inform clients of any limitations.

11. Invoicing Terms

Full payment of any balance is due upon completion; an invoice will be sent to the person or company at the time of the completion of the Service. Payment options include cash or bank transfer (EFT).

12. Purchase Orders

If purchase order numbers are required for an invoice to be paid, it is the responsibility of the Client to provide this to Proshine.

 When booking a service, the Client acknowledges that they find all specifications and conditions acceptable and agree to them. By doing so, the Client grants Proshine Pressure Washing permission to carry out the work outlined in the proposal/estimate form and agrees to abide by all terms and conditions.
